Il giorno 6 ottobre 2016 l’avvocata turca Serife Ceren Uysal è stata invitata come ospite d’onore nella giornata di apertura del Congresso Nazionale Forense[1] a Rimini.
Ecco il suo discorso all’avvocatura italiana:
Care colleghe e colleghi,
Mi chiamo Serife Ceren Uysal, sono avvocata ad Istanbul e faccio parte dell’esecutivo della Associazione degli Avvocati Progressisti ÇHD.
Vi ringrazio molto per questo invito, ne sono veramente molto onorata.
Voglio ringraziare anche tutti i Consigli dell’Ordine che ci hanno espresso la loro solidarietà e che hanno inviato delegati alle nostre udienze in Turchia.
Inoltre voglio fare un ringraziamento particolare ai Giuristi Democratici e alle Camere Penali, per la solidarietà che ci hanno dimostrato da anni in concreto. Quando più volte noi siamo stati attaccati in Turchia, voi ci avete inviato comunicati di solidarietà, avete partecipato alle nostre udienze come osservatori. Perfino a Cizre e a Diyarbakir, quando volevamo preparare il rapporto sulle città sottoposte al coprifuoco, sui distretti dove il Governo attaccava la popolazione civile con armi pesanti, i nostri colleghi italiani sono venuti con noi, fianco a fianco, correndo gli stessi rischi. Questa solidarietà ha un valore enorme per noi. Noi ci sentiamo più forti, sentiamo di non essere soli. Ma questo messaggio che noi non siamo soli arriva anche al Governo. E questo ha una importanza fondamentale.
Voglio spiegarvi da dove vengo. Come sapete, adesso ovunque si parla della Turchia perchè il 15 luglio c’è stato un colpo di stato. Ma io voglio partire da un tempo precedente.
Io sono avvocata dal 2007. In questo breve periodo, neanche 10 anni, io sono stata una dei difensori degli avvocati curdi che hanno passato anni in carcere, solo perché erano gli avvocati di Abdullah Ocalan, che è detenuto in isolamento sull’isola di Imrali da anni e anni, e si vede negati i suoi diritti fondamentali, nonostante le sentenze della Corte Europea dei Diritti Umani.
Nel 2011 il Governo ha deciso una grande operazione contro gli avvocati curdi ed ha arrestato 46 di loro. Poco tempo dopo, nel 2013, il Governo ha organizzato un altro attacco di massa, questa volta contro la mia associazione ÇHD, e 9 dei miei colleghi sono stati arrestati e sono rimasti in carcere per oltre 1 anno.
Quest'anno il Governo ha attaccato la nostra associazione gemella OHD, gli avvocati libertari, ed hanno arrestato Ramazan ed Ayse, di cui voi conoscete la storia. Ramazan e Ayse erano i difensori di tutti gli altri avvocati che si trovano in carcere in Turchia. Quindi, da noi c’è un circolo vizioso. Il nostro posto nelle aule dei tribunali cambia ogni giorno. Qualche volta siamo difensori, qualche volta siamo imputati.
Questi che vi ho raccontato sono gli esempi di operazioni di massa contro gli avvocati in Turchia a causa della loro funzione nel processo. Ma questa non è la fine della storia. Qualche settimana fa hanno arrestato il vice presidente della mia associazione, l’avvocato Münip Ermis. Noi abbiamo organizzato una protesta in Turchia e anche gli avvocati di tutta Europa, inclusa l’associazione degli Ordini europea, hanno organizzato campagne di solidarietà. E noi abbiamo potuto toglierlo dalle mani del Governo solo dopo 7 giorni di carcere.
Come giovane avvocata, grazie a Tayyip Erdoan, ho avuto la fortuna di avere la difesa di processi importanti. Ho difeso gli accademici che hanno sottoscritto una dichiarazione contro le violenze del governo nella regione curda del paese, che chiedevano la pace. Per questa firma circa 2000 professori universitari sono stati accusati di fare propaganda del PKK.
Ho anche avuto la fortuna di fare parte del collegio difensivo di Soma, un processo contro una compagnia che ha causato la morte di 301 minatori per il profitto nella collaborazione con il Governo, con cui dividevano i guadagni.
Questo per dirvi che la Turchia non era rose e fiori prima del colpo di stato. Era un Paese in cui in ogni suo angolo tu eri a rischio di fiutare la corruzione. Ma ora è peggio che mai.
Tutti parlano del colpo di stato. Ma io voglio parlarvi delle ultime elezioni. Il 7 di giugno noi abbiamo avuto le ultime elezioni. Dal mio punto di vista, le ultime elezioni legittime. Dopo sono iniziati gli attentati. ISIS ha messo la bomba al centro Amara, in un punto di raccolta organizzato da ragazzi giovani per portare giocattoli ai bambini di Kobane. E ISIS ha fatto esplodere la bomba alla manifestazione di Ankara, tra 4 giorni sarà l’anniversario. Più di 100 persone che erano là solo per chiedere la pace per il popolo curdo sono state uccise. E non si sono fermati. Il Governo e soprattutto il Presidente Erdogan hanno usato queste bombe come uno strumento per opprimere la popolazione e per cancellare le elezioni. Hanno accusato il popolo e il partito curdo e hanno iniziato ad attaccare le loro città. Il Governo ha distrutto intere città. Adesso a Cizre o a Sur non esistono più interi quartieri. Hanno distrutto le città e quando annunciavano il coprifuoco non hanno dato tempo alle persone civili per allontanarsi dalle città. Non hanno restituito i corpi dei bambini alle loro famiglie.
Da noi in Turchia le cose non andavano bene prima del colpo di stato per i curdi, per chi era di sinistra, anche solo per chi era democratico e difendeva i diritti umani.
Dopo il colpo di Stato, nei giorni immediatamente successivi, il Governo ha pubblicato migliaia di nomi. Lo sapete, più di 40000 persone sono in carcere, inclusi 3000 giudici e pubblici ministeri. Circa 100000 persone sono state rimosse da pubblici incarici, inclusi accademici che erano noti come pacifisti. Quindi il Governo non sta facendo i conti con l’organizzazione di FETÖ Gülen, ma sta perseguitando e arrestando persone che sono molto bene conosciute per la loro identità politica, giornalisti, professori, avvocati. E un altro metodo che usa per attaccarli è revocare il passaporto. Per Ramazan, Ayse, e tanti altri avvocati di Öcalan,i passaporti sono stati revocati. Noi ci aspettiamo di sentire altre notizie di questo tipo molto presto.
La situazione degli avvocati è più difficile che mai. Nel passato ci attaccavao e ci arrestavano per impedirci di fare il nostro lavoro. Ma adesso anche solo visitare un assistito in carcere è impossibile. Vedere i fascicoli di indagine, impossibile. Il decreto che ha disposto lo stato di mergenza prevede che una persona può essere trattenuta nella stazione di polizia senza vedere un avvocato per 5 giorni. Inoltre lo stato di fermo può essere prolungato fino a 30 giorni. Anche entrare in un Tribunale diventa una sfida per noi oggi.
E’ difficile dire ora cosa succederà. Ci hanno annunciato che lo stato di emergenza continuerà fino al 19 gennaio. E Erdogan ha anche detto che anche se è illegale, potranno continuarlo per 1 anno.
Io vorrei sottolineare che oggi gli avvocati in Turchia stanno facendo il loro lavoro sotto un regime fascista. E le condizioni peggiorano giorno dopo giorno.
Per me è importante ripetere che il vostro supporto e la vostra solidarietà oggi sono più importanti che mai. Noi ne abbiamo bisogno non solo per i diritti fondamentali degli avvocati, ma anche perché se oggi in Turchia gli avvocati non possono fare il loro lavoro, significa che più bambini verranno bombardati dal Governo nelle città curde, più giovani ragazzi verranno arrestati per i loro discorsi e i loro pensieri e più persone sperimenteranno la tortura. Questa non è solo una lotta per i diritti degli avvocati, questa è una lotta per la democrazia, la libertà, i diritti fondamentali di tutte quelle persone che non supportano l’AKP, è anche una lotta per il diritto alla vita stessa.
Io vi ringrazio ancora molto per questa opportunità. E vi chiedo di perdonarmi per il mio poco italiano.

The 6 of October 2016 the turkish lawyer Serife Ceren Uysal was invited as honour guest in opening day of the italian National Bar Council meeting1 held in Rimini.
This is her speech to italian lawyers:
Dear all
I am Serife Ceren Uysal, I am lawyer in Istanbul and an executive board member of ÇHD; Progressive Lawyer Association.
I would like to thank you in many aspects. First of all I would like to thank you for this invitation. I am really proud of this.
And secondly I would like to thank all the Italian bar associations that showed to us their solidarity and that send delegates to our hearings in Turkey.
I want also to give a special thank to Italian Democratic Lawyers (GD/AED) and italian Criminal Chambers, Cause since years, Italian lawyers had organize the most effective solidarity with us.When we were attacked in Turkey in different times, you made statements, many of our collegues particapated to our trials as observer. Even when we were in Cizre / Diyarbakir and wanted to prepare a report about the districts under the curfew, about the districs which the government attacked with heavy guns, our italian collegues came with us to there and took all the risk with us... This solidarity has a great meaning for us. We feel strong, we sense that we are not alone. But also the state get the same message. And this has a great importance.
I would like to explain you, where I am coming. As you know, now in everywhere Turkey is an issue of discussions because of the coup attemp which had happened at 15th of July. But I would like to start in an early moment.
I am a lawyer since 2007. In this short term, even not 10 years, I was the lawyer of Kurdish lawyers who spent years in jail, just because they were the lawyers of Abdullah Öcalan, who is isolated for years and years in an island and even can not reach very fundemantel rights, despite the judgement of ECHR.
In 2011, state made a mass operation against Kurdish lawyers and they arrested 46 of them. A short time later, in 2013 state organized an another mass attack this time to my association ÇHD and 9 of my collegues arrested and stayed in jail more than 1 year.
This year this time they attacked our brother association, Lawyers for Freedom association and they arrested Ramazan and Ayse. Ramazan and Ayse were lawyers of all the other lawyers in Turkey who were in jail. So, we have a vicious cycle. Our place in the courtroom is changing eveyday. Some times we are lawyers, some times we are defendants.
So, these are the only examples of mass operations against lawyer due to their role in judicial process.But this is not the end of the story. Weeks ago, they arrested the vise president of my association; Münip Ermi?. We organized a campaign in Turkey and also the lawyers all over the Europe, including Europian Bar Association organized a solidarity campaign. And we could get him back from the states' hand after 7 days.
As a young lawyer, I had always have the chance to be a part of important cases, thanks to Tayyip Erdo?an. I defended academics, who had signed a decleration against the politics of government in Kurdish area. Who had asked for peace. And cause of this around 2000 academics had accused to make propaganda of PKK.
I had a chance to be a part of the defence team in Soma, where the trial against the company which caused the deaths of 301 miners cause of profit with the cooperation of state. Cause they were sharing the profit.
So Turkey was not a rose garden before the coup attemp. It was a country in every part of it, you had a risk to smell the corruption. But now it is worse than ever.
Everyone is talking about coup attemp. But I would like to tell you about the last election. At 7th of June, we had the last election. For my perspective, the last legistimate election. After this the bombings had started. ISIS bombed a public release which had organized by young people just to carry toys for the children in Kobane. And than ISIS bomb a demonstrations in Ankara, (4 days later, 10th of October will be the anniversary) More than 100 people who were there just for asking peace for Kurdish people had been killed. And then it did not stop. The government and especially president used this as a tool to supress the society and they just cancelled the elections. Blame the Kurdish people and party and started to attack the Kurdish districts. They destroyed cities. Now we do not have a district which is called Sur or Cizre... They destroyed the cities and with announcing curfew, they even did not let the people to leave the area. They did not give the bodies of the young children to their families.
So things were not good for the people who are Kurdish, who are leftist, who are even just democrat and supports human rights in Turkey before the coup attemp.
After the coup attemp, the very early next day, state published thousands of names. And know, more than 40.000 people are in jail, including at least 3000 thousand judges and prosecutors. Around 100000 people dismissed from public services including academics who had known as Peace For Academics. So, know the state is not dealing with this FETÖ Gülen organization but they are again attacking and arresting the people who are very well known with their political identities, journalists, academics, lawyers etc... And their other method is cancelling passports. Ramazan, Ayse, many lawyers who are the lawyers of Öcalan, their passports had cancelled. And we are expecting to hear more very soon.
The situation of lawyers are more difficult then ever. In the past they were directly attacking us and arrested us but know they are preventing our role in judicial process. Also there is no judicial process. But now visiting a client in prison, impossible. Examining evidences in a file, impossible. According to state of emerceny, the governmental decree says that a person can stay in police station without accesing lawyer for 5 days. And this detention can be 30 days. Even entering the courthouses is a challange for us right now.
It is hard to know what will happen next. But they announced that the state of emergency will contunie till 19 January. And Erdo?an also mentioned that even it is illegal, they could reannounce it for 1 year. I would like to underline that, in Turkey right now, lawyers are doing their jobs under the fasizm conditions. And it will be worse day by day.
So, I really would like to underline that your support, your solidarity is now more important than ever. We need it not just because of lawyer’s fundemental rights but also we need it because if lawyers can not do their jobs in Turkey, it means that more children will day under the state bombs in Kurdish area, more young people will be arrested because of their speeches and thoughts and many people will face with torture. So this is not just a fight for the lawyers’ rights but this is a fight for democrasy, freedom, to the fundemantal human rights of the people who are not supporting AKP, even this is a fight for the right to live.
